Terms of Service

The Service is provided by Altaaf Hamod, publicly known as MrVampCruz, based in Mauritius. MrVampCruz Uptime is a personal status / monitoring site by MrVampCruz (Altaaf Hamod), a software engineer from Mauritius. MrVampCruz is a personal brand — not a registered company.

You may use the Service only if:

• You are at least 16 years old (or the higher age of digital consent in your jurisdiction)
• You have the legal capacity to enter a binding agreement
• You are not prohibited from using the Service under applicable law
• If you use the Service on behalf of an organization, you have authority to bind that organization — in which case “you” includes that organization

You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account. Notify us promptly at mrvampcruz@proton.me if you suspect unauthorized access.

We may suspend or terminate accounts that are inactive, unpaid, abusive, fraudulent, or otherwise in breach of these Terms.

MrVampCruz Uptime provides uptime monitoring, incident tracking, alerts, a public status experience for selected surfaces, billing, and related dashboard tools. Features available to you depend on your plan and account status.

We may modify, add, or remove features; change check intervals or limits; or discontinue parts of the Service. Where a change materially reduces paid functionality, we will use reasonable efforts to provide notice.

The Service is provided on a commercially reasonable basis. Monitoring depends on networks, DNS, third-party targets, and infrastructure outside our control. We do not guarantee uninterrupted checks, perfect detection, zero false positives/negatives, or delivery of every alert.

You agree not to:

• Use the Service for unlawful, harmful, or fraudulent purposes
• Monitor systems you are not authorized to monitor
• Attempt to bypass plan limits, trial restrictions, payment requirements, or security controls
• Create multiple accounts to obtain additional free trials or evade bans
• Interfere with or disrupt the Service, other users, or underlying infrastructure
• Reverse engineer, scrape, or abuse APIs except as expressly permitted
• Upload malware or content that infringes others’ rights
• Misrepresent your identity or affiliation in a way that harms us or others
• Use the Service in a way that generates abusive traffic against third parties

We may investigate suspected violations and take action including suspension, termination, retention of abuse signals, and cooperation with payment providers or authorities.

6.1 Plans

Free and paid plans, limits, and pricing are described on the Pricing page and in the billing area of your account. We may change plans and prices prospectively; existing subscriptions continue under their then- current terms until renewal or change according to PayPal and our billing flow.

6.2 Trials

Some paid plans may include a free trial. Trials are generally limited to one per person/identity. We may enforce this using email, PayPal payer ID, related identifiers, and other anti-abuse signals — including after account deletion. Creating new accounts to obtain additional trials is prohibited.

6.3 PayPal payments

Paid subscriptions and upgrades are processed through PayPal. By starting checkout, you also agree to PayPal’s applicable terms. During OpenID Connect / OAuth flows, PayPal may share with us attributes such as:

• Full name and email
• Street address, city, state, country, and postal code
• PayPal account verification status
• PayPal account ID (payer ID)

How we handle that data is described in our Privacy Policy. You authorize us to instruct PayPal to charge your selected funding source for recurring subscription fees, prorated upgrades, and related amounts according to your plan.

6.4 Renewals, failures, and lockout

Subscriptions renew according to the billing interval of your plan unless cancelled. If payment fails, we may mark your account as payment-required, restrict access to paid features or the dashboard, and retry or await PayPal’s resolution. Restoring access may require successful payment or updating your PayPal funding source.

6.5 Upgrades, downgrades, and cancellation

Plan changes may be immediate or take effect at the next billing cycle depending on the change type. Paid-to-paid upgrades may be prorated. Cancellation stops future renewals according to PayPal and our billing integration; it does not automatically refund the current period unless required by law or we expressly agree otherwise.

6.6 Refunds

Except where required by applicable consumer law, fees are generally non-refundable. We may issue refunds or credits at our discretion (including via PayPal) for billing errors or goodwill. Chargebacks filed in bad faith may result in account termination and retention of related records.

6.7 Taxes

Prices may be exclusive of taxes. You are responsible for any taxes associated with your purchase, except taxes based on our net income.

You retain ownership of content you submit (for example monitor names, notes, and configurations). You grant us a worldwide, non-exclusive license to host, process, and display that content solely to operate and improve the Service.

You represent that you have all rights necessary to monitor the targets you configure and that doing so will not violate law or third-party terms.

The Service, including software, design, branding, and documentation, is owned by Altaaf Hamod / MrVampCruz or its licensors. These Terms do not grant you any ownership interest. You may not copy, modify, or redistribute our materials except as allowed by law or with prior written permission.

Our collection and use of personal information is described in the Privacy Policy, which forms part of your agreement with us.

You may delete your account from Settings (or by contacting us). Upon deletion we cancel active PayPal subscriptions where our integration supports it, remove live access, and may retain archives and identity signals as described in the Privacy Policy for anti-abuse, legal, and operational purposes. Deletion does not entitle you to a refund of prepaid fees unless required by law.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Without limiting the foregoing, we do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that monitoring results will be accurate or complete.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Altaaf Hamod, MrVampCruz, AND THEIR SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

You agree to defend, indemnify, and hold harmless Altaaf Hamod, MrVampCruz, and their agents from and against claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your monitors or content, your breach of these Terms, or your violation of law or third-party rights.

We may suspend or terminate access immediately if you breach these Terms, if required by law, if payment fails, or if continued operation poses risk to the Service or others. You may stop using the Service at any time and may delete your account as described above.

Sections that by their nature should survive (including billing obligations already incurred, IP, disclaimers, liability limits, indemnity, and governing law) will survive termination.

These Terms are governed by the laws of Mauritius, without regard to conflict-of-law principles. Courts located in Mauritius shall have exclusive jurisdiction over disputes arising from these Terms or the Service, except where mandatory consumer protections in your country give you a right to bring claims elsewhere.

Before filing a formal claim, please contact us at mrvampcruz@proton.me so we can try to resolve the issue informally.

• These Terms are the entire agreement between you and us regarding the Service, superseding prior agreements on the same subject.
• If any provision is found unenforceable, the remaining provisions remain in effect.
• Our failure to enforce a provision is not a waiver.
• You may not assign these Terms without our consent; we may assign them in connection with a reorganization or transfer of the Service.
• We may provide notices via email, in-product messages, or by posting to the Service.
• Headings are for convenience only.

We may update these Terms from time to time. The “Last updated” date will change when we do. Material changes may be communicated by email or in-product notice. Continued use after the effective date constitutes acceptance, except where applicable law requires otherwise. If you do not agree, you must stop using the Service and may delete your account.
